Who this statement applies to and what it covers?

This Statement applies to individuals or firms, who access, use, and/or interact with our products, services, websites, digital properties, platforms, software, and application(s), including mobile application (“app”) if any, (including third-party platforms that host our websites and/or content) that hyperlink to this Statement (we call these our “Services”), attend our events or events hosted at our premises; to independent contractors or consultants whom we engage to perform and/or provide a service; and to subcontractors, vendors, suppliers, or service providers and to the personnel of the same.

This Policy outlines how Smart Audit Pte.Ltd. (hereinafter referred to as ‘Smart Audit’) collect, use, maintain and disclose your Personal Data.

Smart Audit Pte. Ltd. is a company incorporated in Singapore, and hence it safeguards Personal Data in accordance with the Singapore Personal Data Protection Act (No. 26 of 2012) (“the Act”). The registered address of the company is #09-07, Shenton House, 3 Shenton Way, Singapore 068805.

This Privacy Policy supplements but does not supersede nor replace any other consents which you may have previously provided to us in respect of your Personal Data, and your consents herein are additional to any rights which we may have at law to collect, use or disclose your Personal Data.

What data do we collect?
Personal Data

For the purposes of this Policy, 'Personal data' means data, whether true or not, about an individual who can be identified:

(a) from that data; or
(b) from that data and other information to which the organisation has or is likely to have access;

Examples of such Personal Data you may provide to us may include (depending on the nature of your interaction with us) Your name, NRIC, passport or other identification number, telephone number(s), mailing address, email address and any other information relating to any individuals which you have provided us in any forms you may have submitted to us, or via other forms of interaction with you. You may also provide us with Personal Data of your officers, employees, agents, and customers in order for us to provide you with our products and services.

The Personal Data we collect can be either obligatory or voluntary.

Obligatory Personal Data are those that we require in order to provide you with our products and services. If you do not provide us with obligatory Personal Data, we would not be able to provide you with our products and services.

Voluntary Personal Data are those that are not mandatory in order for us to provide you with our products and services. If you do not provide us with voluntary Personal Data, you can still sign up for our products and services. Obligatory and voluntary Personal Data differ for each products and services and will be indicated in the application forms.

Other Information

Apart from Personal Data, we may collect other types of information which is not related to an individual and which is anonymous. For example, the number of website visitors and the number of website users using a particular service. In this way, we hope to improve our customer services.

Why do we collect and process the 'Personal Data'?

Generally, Smart Audit collects, uses and discloses your Personal data for the following purposes:

a) providing a service and/or product to you;
b) meeting or complying with any applicable laws, regulations, directives, rules, codes of practice or guidelines issued by any legal or regulatory bodies which Smart Audit may be subject, whether local or overseas (including but not limited to disclosures to regulatory bodies, conducting audit checks, surveillance, and investigation).
c) resolving complaints and handling requests and enquiries;
d) purposes which are reasonably related to the aforesaid.
e) preventing, detecting, and investigating crime, including fraud and money-laundering, and analysing and managing commercial risks communicating with you on matters relating to your account relationship with us or your interest in our products and/or services.

How do we collect and process the 'Personal Data'?

The personal data may be collected through ways such as:

When you use our services
When you sign up for our product or use the services we provide or when you register an account at Smart Audit website
When you contact us through channels such as sign up forms, emails, Calls.
When you submit your Personal Data to us for any other reasons.

We may obtain Personal data from our website. This data comprises of IP Address and Information on cookies.

Consent for the Collection, Use and Disclosure of Data

When you request information or sign up for our products and services, you may be required to provide us with your Personal Data. In doing so, you agree and consent to Smart Audit as well as our respective agents, business partners, authorised service providers and relevant third parties collecting, using, disclosing and/or sharing your Personal Data in accordance with this Privacy Policy.

In addition, there may be circumstances under applicable laws where we are permitted to collect, process and disclose your Personal Data without your consents.

Withdrawal of consent

At any time, you have a choice not to provide your Personal Data or to withdraw your consent to Smart Audit processing your Personal Data. However, do note that failure to provide such Personal Data or a withdrawal of your consent for us to process your Personal Data may result in Smart Audit being unable to provide you with effective and continuous products and services.

If you should withdraw your consent to the processing or handling of your Personal Data in respect of any purpose which we may reasonably consider to be essential in order for us to provide you with the products and/or services requested / applied for, we may not be in a position to continue to provide our products or services to you or administer any contractual relationship which may be in place between us. Furthermore, we shall be entitled to treat such withdrawal as your termination of any account /agreement which you may have with us, without prejudice to any rights and remedies which we may have at law against you.

Your rights in relation to Personal Data

You may have certain rights in relation to the Personal Data we hold about you, which we detail below.

Access to Personal Data

You have the right to request your personal data that is in the possession or under the control of the Smart Audit; or any information about the ways in which the personal data has been or may have been used or disclosed by the organisation within a year before the date of the request.

Where the law permits, Smart Audit reserves the right to charge a reasonable administrative fee for this service. In exceptional circumstances, Smart Audit reserves the right to deny you access to your Personal Data and may provide an explanation as required by applicable laws.

Correction of Personal Data

You have the right to request Smart Audit to correct an error or omission in the personal data about the individual that is in the possession or under the control of the organisation.

Where do we process and store your Personal Data?

Smart Audit is incorporated and headquartered in Singapore. Personal Data will be transmitted to data storage facilities where Smart Audit keeps its central records. Personal Data will be transferred to Smart Audit offices and appointed agents, where appropriate, in Singapore and around the world in connection with Smart Audit performance of the contract with you.

Who we disclose your personal data to?

Your Personal Data held by us shall be kept confidential at all times. However, in order to provide you with effective and continuous products and services, and for the purposes mentioned above (wherever applicable), Your Personal data may be provided to the following:

a) Related companies of Smart Audit, companies providing services relating to insurance and/or reinsurance to Smart Audit, agents, contractors or third party service providers who provide operational services to Smart Audit, such as courier services, telecommunications, information technology, payment, payroll, processing, training, survey, market research, storage, archival or other services to Smart Audit;
b) vendors and other third party service providers in connection with promotions, online campaigns, products and services offered by Smart Audit,
c) credit bureaus and credit reporting agencies;
d) our professional advisers such as financial advisors, auditors and lawyers;
e) relevant regulatory bodies, government agencies, statutory boards, administrative bodies, authorities or law enforcement agencies to comply with any laws, rules, guidelines and regulations or schemes to which Smart Audit may be subject, whether situated locally or overseas;
f) counterparties, billing organisations and their respective banks in relation to fund transfers, payments and drawing of cheques;
g) brokerage houses, fund houses, registrars, custodians, external banks and investment vehicles in relation to any custodial services and settlement processing;
h) external business, referral and charity partners in relation to the marketing and promotion of products, gift redemptions and corporate promotional events; and
i) any other party to whom you authorise us to disclose your Personal Data to.

In addition, to the extent that we may need to transfer Personal Data outside of Singapore, whether to our affiliates, related companies, business partners, authorized agents or third party service providers or simply to data storage facilities, we endeavour to do so in accordance with the Act to ensure that we provide a standard of protection to personal data so transferred that is comparable to the protection under the Act.

Why your Information can be transferred abroad?

Smart Audit provides a global service and your personal information may be stored and processed outside of your home country, including in countries that may not offer the same level of protection for your personal information as your home country. We have measures in place to ensure that when your personal information is transferred internationally, it is subject to appropriate safeguards in accordance with data protection laws. Often, these include contractual safeguards.

How do we Secure your Data?

Information security is the most important to us and to achieve that, we use a range of physical, technical and organisational measures to keep your personal information secure, accurate and relevant. The measures and policies are closely aligned with widely accepted international standards, reviewed regularly and updated as necessary to meet our business needs and changes in technology and regulatory requirements. We make reasonable efforts to ensure a level of security appropriate to the risk of the processing, taking into account the costs of implementation and nature of the processing of Personal Data.

Access to Personal Data is only limited to authorised personnel of Smart Audit who are fully trained to handle confidential information. They need to ensure the confidentiality and privacy of the your data and observe the privacy policy at all times, failing which they will be subjected to disciplinary action. The same is reflected in the relevant employment contract. If we disclose any of your Personal Data to our business partners, authorised agents or service providers, we will require them to appropriately safeguard the Personal Data provided to them.

However, no one can guarantee the complete safety of your information. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting Customer Service in accordance with the instructions below.

How long we will Retain your data?

We will retain your Personal Data for the period necessary to fulfil the purposes outlined in this Privacy Notice unless a longer retention period is required or allowed by law. If the individual’s Personal Data is no longer needed for legal or business purposes, D&B will remove, destroy and anonymize the individual’s Personal Data.

Accuracy, Access and Correction of your Personal Data

Please ensure that all Personal Data submitted to us is complete, accurate, true and correct. Failure to do so may result in our inability to provide you with products and services you have requested / applied for.

If there are any changes to your Personal Data or if you believe that the Personal Data we have about you is inaccurate, incomplete, misleading or not up-to-date, please contact us so that we may take steps to update your Personal Data.

You have the right to access your Personal Data. If you would like to request access to your Personal Data, please contact us. Please note that depending on the information requested we may charge a small fee. We may also take steps to verify your identity before fulfilling your request for access to your Personal Data. However, in exceptional circumstances, we reserve the right to deny you access to your Personal Data and may provide an explanation as required or unless permissible by applicable laws.

Changes to this Privacy Statement

We may modify or amend this privacy statement from time to time. Any future changes or additions to the processing of personal information as described in this privacy statement affecting you will be communicated to you through an appropriate channel, depending on how we normally communicate with you.
